This Privacy Policy describes how Epic Surf Racks, LLC (the “Site” or “we”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site.

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information about an identifiable individual (including the information below) as “Personal Information”. See the list below for more information about what Personal Information we collect and why.

  • Device information
    • Purpose of collection: to load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.
    • Source of collection: Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels.
    • Disclosure for a business purpose: shared with our processor Shopify
    • Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.
  • Order information
    • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, to process and ship orders, arrange for shipping or other logistical tasks, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
    • Source of collection: collected from you.
    • Disclosure for a business purpose: shared with our processor Shopify, Google, Microsoft, Pinterest, Meta, Paypal, Amazon Pay, Judge.me., Zapier, and third party logistics & fulfillment providers who may process and ship orders.  We are in the process of ensuring that appropriate data protection agreements are in place with these providers to comply with applicable privacy laws such as the GDPR and CCPA.

      We also use Google Enhanced Conversions, a feature of Google Ads, which transmits hashed (one-way encrypted) versions of customer data — including email address, name, phone number, and address — to Google at the time of a completed purchase. This data is used solely for the purpose of improving the accuracy of Google’s conversion measurement and is governed by Google’s Privacy Policy (https://policies.google.com/privacy). Google does not use this data to serve ads.

      We use Simpsosys to manage and submit our Google Shopping product feed. Simpsosys may access product and order data from our store for the purpose of generating and maintaining accurate product listings in Google Shopping. Simpsosys acts as a data processor on our behalf and is not authorized to use your data for any other purpose. Minors

The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address above to request deletion.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

  • We use Shopify to power our online store. You can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy.
  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Behavioural Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

  • We use Google Analytics to help us understand how our customers use the Site. You can read more about how Google uses your Personal Information here: https://www.google.com/intl/en/policies/privacy/. You can also opt-out of Google Analytics here: https://tools.google.com/dlpage/gaoptout.
  • We share information about your use of the Site, your purchases, and your interaction with our ads on other websites with our advertising partners. We collect and share some of this information directly with our advertising partners, and in some cases through the use of cookies or other similar technologies (which you may consent to, depending on your location).
  • We use Shopify Audiences to help us show ads on other websites with our advertising partners to buyers who made purchases with other Shopify merchants and who may also be interested in what we have to offer. We also share information about your use of the Site, your purchases, and the email address associated with your purchases with Shopify Audiences, through which other Shopify merchants may make offers you may be interested in.
  • We use Google Enhanced Conversions for Web to improve the accuracy of our Google Ads conversion tracking. When you complete a purchase, certain first-party data — including your email address, name, phone number, and shipping address — is hashed (encrypted using a one-way algorithm) and sent to Google. Google uses this hashed data only to match your transaction to a prior ad interaction for reporting purposes. This practice is separate from ad personalization. Using Personal Information

We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

Lawful basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your personal information under the following lawful bases:

  • Your consent;
  • The performance of the contract between you and the Site;
  • Compliance with our legal obligations;
  • To protect your vital interests;
  • To perform a task carried out in the public interest;
  • For our legitimate interests, which do not override your fundamental rights and freedoms.

Retention

We retain your Personal Information for as long as necessary to fulfill the purposes for which it was collected, including to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements.

Specifically:

  • Order and transaction data is retained for a minimum of 7 years to comply with tax, accounting, and legal record-keeping requirements, even if you request deletion.

  • Account information is retained for as long as your account remains active, or as needed to provide services.

  • Marketing and behavioral data (such as cookies and browsing history) is retained in accordance with the retention periods disclosed in our cookie tables above.

  • Customer service communications are retained for up to 3 years.

If you request deletion of your Personal Information, we will honor that request to the extent permitted by law. Certain categories of data may be exempt from deletion where retention is required for legal compliance, fraud prevention, or to complete a transaction you requested.

Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
  • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

Selling Personal Information

Epic Surf Racks, LLC does not sell your Personal Information to third parties for monetary consideration.

However, we do share certain Personal Information with third-party advertising partners (such as Google, Meta, and Pinterest) for cross-context behavioral advertising purposes. Under the California Privacy Rights Act ("CPRA"), this type of sharing may be considered a "sale" or "sharing" of Personal Information. California residents have the right to opt out of this sharing. Please see the "Your California Privacy Rights" section below, or click the link in our website footer titled "Do Not Sell or Share My Personal Information" to exercise this right.

GDPR

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. If you would like to exercise these rights, please contact us through the contact information above.

Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. Your California Privacy Rights (CCPA/CPRA)

If you are a resident of California, the California Consumer Privacy Act of 2018 and the California Privacy Rights Act of 2023 (collectively, "CCPA/CPRA") grant you certain rights regarding your Personal Information.

Right to Limit Use of Sensitive Personal Information: You have the right to direct us to limit our use of your Sensitive Personal Information (which includes payment card information) to only what is necessary to perform the services you requested.

Right to Non-Discrimination: You have the right to not receive discriminatory treatment for exercising your privacy rights.

We will respond to a verified request within 45 days of receipt. If additional time is needed, we will notify you in writing. You may submit a request no more than twice in a 12-month period.

We will not discriminate against you for exercising any of your CCPA/CPRA rights.

Do Not Sell Or Share My Personal Information

If you are a California resident, you have the right to opt out of the "sale" or "sharing" of your Personal Information for cross-context behavioral advertising purposes under the California Privacy Rights Act ("CPRA").

We share certain information (such as browsing behavior, purchase history, and device identifiers) with advertising partners including Google, Meta (Facebook/Instagram), Pinterest, and Microsoft (Bing) for the purpose of showing you targeted advertisements.
